Delaware limits who can get a certified copy of a Delaware City birth record under 72 years old. The rule is 16 Del.C. § 3110. The state can issue a copy only to the registrant, a spouse, a child, a parent, a guardian, or an authorized representative. A court order can also open the record to a third party. Anyone asking as family must bring proof of the link, such as their own birth certificate or a marriage license.

Once a Delaware City birth record passes the 72 year mark, it becomes a public record. The state moves it to the Delaware Public Archives, and any researcher can see or copy it. This 72 year rule applies to all Delaware birth records, not just those from Delaware City.

You can visit the Archives in person during business hours or send a research request to archives@delaware.gov. The office asks for up to five specific references per email, with the county, name, date, volume, and page number for each.

Delaware Birth Records Law Summary

The law for Delaware City birth records is the same law that covers the whole state. Title 16, Chapter 31 of the Delaware Code is called Vital Statistics. It sets up the Office of Vital Statistics, names the State Registrar, and spells out how every live birth is filed in the state. Delaware City births go through this same path.

Under 16 Del.C. § 3101, a "live birth" is defined to include any product of human conception that shows signs of life after separation from the mother. Section 3104 names the Office of Vital Statistics as the only state body that holds these records. Section 3105 sets the job of the State Registrar as the keeper of the files. These three sections leave no room for Delaware City to keep a parallel file.

Section 3111 lists the penalties. Making a false statement on a birth certificate, or changing a Delaware City birth record, can bring a fine of up to $10,000 or up to five years in prison. Lesser offenses like refusing to give required information bring fines of up to $1,000. See Subchapter II for the newer sections on adoption, paternity, and stillbirth.

The Delaware Vital Statistics Regulations fill in the fine detail that the code leaves open, such as how to handle a home birth or a delayed registration.

Heads up: The Delaware Vital Events Registration System, called DelVERS, is not a public search tool. You cannot look up a Delaware City birth record through DelVERS.
